Terms and Conditions

All services and products provided by Markspixel are subject to the following terms and conditions.

Quotes and Contracts

Any quotes made by Markspixel will be valid for 30 days. A new quote may be requested after that time. Contracts that have been written but not signed by the client are valid for 30 days, however a new contract may be drawn after this time.

Charges and Fees

Design projects which are charged at a monthly rate will require the first payment to be made when the design is started. The client will be given access to any services such as hosting, domain and email after the initial payment has been made. Such services will be setup within 48 hours of the clients request, and Markspixel is not required to initiate these services unless the client has requested to do so or if the design has been completed. All rates drop to $19.95 per month after 6 months. There are no contracts and no requirements for the client to stay with Markspixel after the design has been completed.

Design projects which are charged as a one time fee of less than $1000 USD will need to be paid with a 50% payment upfront. Any other projects of a value of $1000 USD or more will be made in 4 payments or less each of which shall total 25% or more of the total cost of the project.

Markspixel retains the right to hold all content, graphics, and code developed by Markspixel until any payments have cleared.

Payments

Markspixel accepts payment via Paypal, Credit Card, Check, or Cash. Payments via Paypal should be made with backup funding any payment made via E-check may require Markspixel to wait several days before the project can begin. Credit Card payments can be made via our secure credit card processor 2Checkout and may require clients to wait up to 48hours for their product or service to become active, all payments are processed by our fraud review system for extra security and safety. Check or Cash payments can be made in person to a Markspixel representative or by mail, please understand that Markspixel may wait until a check has processed before any product or service will be initiated. Outstanding invoices will be charged with a 16% late fee every month it is more than 4 months overdue and will later be handled by a 3rd party collections company if needed.

Web Site Design Credit

All websites designed by Markspixel will be required to have a "Design by Markspixel" link on their footer of every page. This is non-negotiable. By hiring Markspixel to work on your website you understand this and the link can not be removed without our consent. You may pay Markspixel a fee of $100 to have the link removed permanently. If you change to a different layout not designed or provided by us you may remove the link. Markspixel also reserves the right to include any design in our portfolio and any advertising and marketing. If you would like to be excluded from our portfolio and marketing we ask for a fee of $100.

Copyright and Ownership

After the final payment has been made and processed and the project has been completed Markspixel will transfer all copyright of custom work to our clients. Copyrights or third party scripts, images, logos, and other resources remain with their respective owners.

When purchasing a license to use a template or script created by Markspixel the copyright will remain with Markspixel. Purchasing a unique version of a script or template would remove it from our site within 24 hours and transfer all the copyrights to the buyer.

Refunds

Refunds will be given within 30 days of the clients request to cancel the project and have a refund issued. Refunds will be given in the following ways.

1. If the client has made a down payment for the project but no work has been started Markspixel will refund all of the money which has been paid.

2. If payment has been made and the project has been started Markspixel will refund all but 25% of the total cost for the project.

3. If the project is in its final state, which is defined as having the majority of the coding and design work done with only the content and/or extra features remaining, Markspixel will retain 75% of the total quoted cost of the project.

4. If the project is completed and matches the look of the mockup the client agreed to in the beginning of the project and shows the majority of the features the client requested prior to the start of the project then their will be no refund available.

Refunds will be processed by Markspixel within 30 days of the clients request if there is a refund according to the terms above.

There are no refunds for domains, hosting addons, SSL certificates, leased or purchased scripts or templates.

Full refunds for hosting will be given within 30 days of initial sign up if there is no breach of our terms of service.

Chargebacks

Markspixel will not negotiate charge backs with any person or company. Our refund policy is clearly laid out above and all clients are asked to review and agree to our terms of service prior to starting a project of any kind.

Recommended and third party sites

We are not responsible for the service or quality of third party sites and their services and/or products.
